1. Agreement and Legal Entity

These Terms and Conditions ("Terms") are an agreement between you and Digtize, operating under the brand name Wahob ("Digtize," "Wahob," "we," "our," or "us"). Digtize's registered office is L/D 308, CHD City, Karnal, Haryana, India, 132001. These Terms govern access to wahob.com and our platform, applications, APIs, and related services (collectively, the "Service").

By creating an account, accepting an order, or using the Service, you agree to these Terms and our Privacy Policy. If you act for an organization, you represent that you can bind it, and "you" includes that organization. You must be at least 18 and legally capable of contracting.

2. The Service

Wahob provides business tools for messaging, shared inboxes, campaigns, automations, chatbots, customer and contact management, analytics, APIs, webhooks, and third-party integrations. Features may vary by plan and may change over time. Some features depend on third-party platforms and are not controlled by Digtize.

WhatsApp, Facebook, Instagram, and Messenger services are provided by Meta entities, not Digtize. Digtize is an independent technology provider and does not act as Meta's or WhatsApp's agent. Your use of those services remains subject to all applicable Meta and WhatsApp terms, including the WhatsApp Business Terms, Business Messaging Policy, Commerce Policy, and data-processing terms. Nothing in these Terms guarantees approval, verification, messaging access, delivery, pricing, or continued availability from Meta.

3. Accounts and Security

  • Provide accurate, complete, current business and contact information and keep it updated.
  • Use only accounts, Meta assets, telephone numbers, and data you are authorized to use.
  • Protect passwords, access tokens, API keys, devices, and other credentials; do not share them except with authorized personnel.
  • You are responsible for activity under your account and for configuring appropriate user roles and access.
  • Notify support@wahob.com promptly of suspected unauthorized access, credential exposure, or security incidents.

4. Customer Data, Privacy, and Instructions

You retain ownership of data and content submitted through the Service ("Customer Data"). You instruct and grant Digtize a limited, non-exclusive right to host, copy, transmit, display, and otherwise process Customer Data only as necessary to provide, secure, support, and improve the Service, comply with your documented instructions, and satisfy legal obligations.

You represent and warrant that:

  • You have all rights, permissions, lawful bases, licenses, and consents needed to collect, upload, use, and share Customer Data with Digtize, Meta, WhatsApp, and your selected integrations.
  • You will give individuals all required privacy notices and accurately describe your messaging and data practices.
  • You will respond to individual rights and deletion requests for data you control and will reasonably cooperate with Digtize on such requests.
  • You will not provide sensitive or regulated data unless the Service expressly supports it and you have independently confirmed your legal and security requirements.

Our processing practices are described in the Privacy Policy. You may export available Customer Data and request deletion through our Data Deletion page.

5. WhatsApp and Meta Compliance

You must at all times:

  • Comply with applicable Meta and WhatsApp terms, policies, documentation, quality requirements, and technical restrictions.
  • Obtain valid opt-in permission before contacting a person where required, clearly explain the types of messages they will receive, and retain adequate consent records.
  • Honor all opt-out, stop, block, deletion, and other privacy requests promptly and maintain an effective opt-out process.
  • Use approved message templates when required and send messages only within applicable conversation and template rules.
  • Keep business profile information accurate and avoid impersonation, deception, or suggesting an affiliation with Meta beyond an authorization Meta has expressly granted.
  • Use WhatsApp-derived data only as reasonably necessary to support messaging with the person to whom the data relates.
  • Cooperate with investigations and promptly delete data if required by law, Meta, WhatsApp, or Digtize.

Meta or WhatsApp may reject templates, restrict messaging, change pricing or features, or suspend or terminate accounts. Digtize is not liable for such third-party action caused by your conduct or matters outside our reasonable control.

6. Acceptable Use

You must not use or permit use of the Service to:

  • Send spam, unsolicited communications, or messages without required permission.
  • Engage in fraud, phishing, deception, harassment, threats, discrimination, exploitation, or illegal activity.
  • Promote prohibited or restricted goods, services, content, or business categories contrary to law or platform policy.
  • Upload malware, harmful code, or content that infringes privacy, publicity, intellectual-property, or other rights.
  • Scrape data, build unauthorized profiles, sell personal data, or use data obtained from Meta or WhatsApp for an unrelated purpose.
  • Probe, disrupt, overload, bypass, reverse engineer, or gain unauthorized access to the Service or another account.
  • Resell, sublicense, or provide the Service to third parties except under a written agreement with Digtize.

We may investigate suspected violations and limit, suspend, or terminate access to protect users, the Service, Digtize, Meta, WhatsApp, or others, or to comply with law or platform requirements.

7. Subscriptions, Fees, and Taxes

Plans, features, usage allowances, billing cycles, and fees are shown at purchase or in an order. Unless otherwise stated, subscriptions renew automatically for the selected period until canceled. Fees are due in advance, exclusive of applicable taxes, and non-refundable except where required by law or expressly agreed. You authorize us and our payment provider to charge the selected payment method.

Meta/WhatsApp messaging charges, third-party fees, taxes, and usage overages may be billed separately. We may change future pricing with reasonable notice. Cancellation takes effect at the end of the paid billing period unless law or an order states otherwise.

8. Intellectual Property and Feedback

Digtize and its licensors own the Service, software, designs, documentation, trademarks, and related intellectual property, excluding Customer Data and third-party materials. Subject to these Terms and payment of applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for your internal business purposes. Feedback may be used without restriction or compensation, provided we do not publicly identify you without permission.

9. Third-Party Services

Integrations are governed by their providers' terms and privacy policies. You authorize us to exchange data with integrations you enable. We do not control and are not responsible for third-party systems, acts, omissions, security, availability, policy changes, or data practices. You are responsible for disconnecting integrations and revoking permissions when no longer needed.

10. Availability and Changes

We aim to provide a reliable Service but do not guarantee uninterrupted or error-free operation. Maintenance, security events, internet failures, force majeure, and third-party outages may affect availability. We may modify or discontinue features, with reasonable notice where a change materially reduces paid core functionality and notice is practicable.

11. Suspension and Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for material breach, nonpayment, security risk, unlawful conduct, policy violations, third-party platform direction, or risk of harm or liability. Where reasonable, we will provide notice and an opportunity to cure. Upon termination, your right to use the Service ends. Customer Data is handled under our Privacy Policy and Data Deletion process.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." Digtize disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. We do not warrant specific business results, message delivery, Meta approval, or that the Service meets requirements applicable to a regulated industry. Nothing excludes warranties or consumer rights that cannot lawfully be excluded.

13. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, goodwill, or data, even if advised of the possibility. Digtize's aggregate liability arising from the Service will not exceed the fees you paid to Digtize for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot be limited by law.

14. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless Digtize and its personnel from third-party claims, losses, and reasonable costs arising from your Customer Data, messaging practices, breach of these Terms, violation of law or third-party platform policies, or infringement of another person's rights. We will give reasonable notice and cooperation and will not settle a claim imposing non-monetary obligations on you without consent.

15. Governing Law and Disputes

These Terms are governed by the laws of India. The parties will first attempt in good faith to resolve a dispute by written notice and negotiation for 30 days. Subject to any mandatory law, courts with jurisdiction in Karnal, Haryana, India will have exclusive jurisdiction. Nothing prevents either party from seeking urgent injunctive relief or using a remedy that cannot lawfully be waived.

16. General

  • Changes: We may update these Terms and will post the revised version and date. We will provide additional notice of material changes where required.
  • Assignment: You may not assign these Terms without our written consent. We may assign them in a merger, reorganization, sale, or to an affiliate.
  • Severability: If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will continue.
  • No waiver: A failure to enforce a provision is not a waiver.
  • Entire agreement: These Terms, applicable orders, and incorporated policies form the agreement concerning the Service.
